Can’t physically make it out to race day but still want to participate? Not a problem! RACE IN YOUR OWN TIME.
You can complete your race on your own around your home, at the gym on a treadmill or even with a group of running buddies – essentially you can compete anywhere in the world! Our races come with no time pressure – your pace is individual to you and you will earn your medal for completing whatever your speed. You can even walk our races without the fear of crowds at the beginning or at the point in your race when you really could do with that 2 second pause. Running fully nude at any point of the race will not be permitted. I understand that participating in a 5k run/walk is a potentially hazardous activity. I will not enter and participate in this event unless I am medically able and properly trained. I assume all risks from participating in this event and its related activities including, but not limited to: falls, contact with other participants, effects of the weather~~including high heat, humidity, cold, precipitation and conditions of the course. All such risks are known and appreciated by me. I understand that race organizers and all involved parties including 5Kevents.org, the City of Racine, All Sponsors, etc. are not responsible for any injuries or damage while participating in this event. I understand race organizers reserve the right to prohibit any person that appears dangerous to others or may be considered inappropriate for this family event. I understand that bicycles, scooters, skateboards, any type of roller skate, and animals are not allowed on the 5k route during the time of the event. Strollers and wagons are allowed for walkers only and must start at the back of the race after all runners have been released from the start. Having read the waiver and knowing these facts and in consideration of your accepting my entry into this race, I, for myself and anyone entitled to act on my behalf, waive and release 5Kevents.org, the City of Racine, all Sponsors, etc. and all associated businesses, employees, families, officers, board members, volunteers, sponsors, staff, race officials, contractors, agents, and their representatives and successors of and from all claims and liabilities of any kind arising from my participation in this event and associated activities. The release and waiver extends to all claims of every kind and nature whatsoever. I grant permission to all of the foregoing to use any photographs, video, recordings, or any other record of this event for legitimate purposes, including race literature and future race promotion. If I require medical attention, I hereby give consent to authorize medical personnel to provide such medical care as deemed necessary.
WAIVER: I, the undersigned participant (and my parent or guardian if I am younger than 18 years of age), intending to be legally bound, do hereby forever release and waive any and all rights, claims, and actions for damages that we, our heirs, executors, administrators, and assigns may have, or that may hereafter accrue against any and all persons, organizations, and other entities associated with the event, including, but not limited to Race Entry, 5Kevents.org, USA Track and Field, sponsors, affiliates, volunteers, Cinco K Mayo - 5K Run/Walk, and individual Cinco K Mayo - 5K Run/Walk organizers, arising out of or in connection with my involvement before, during, or after the event.
I verify that I am physically fit and sufficiently trained to participate in this event and I assume the risks involved in this activity. I further attest that I will be mindful of traffic along the race course, and hold said sponsors and organizers blameless in any harm that may happen.
I also acknowledge understanding that the charge to my card will show up as Race Entry. I acknowledge that the online processing fees and charitable donations are non-refundable. I also acknowledge that any charitable donations will have 4.97% withheld from the donation to pay credit card and administrative costs.
Race Entry and its partner 5Kevents.org shall not be liable to you for any direct, indirect, special, incidental, consequential or exemplary damages including, but not limited to, loss of profits, goodwill, use, data or other intangible loses. Race Entry and its partner 5Kevents.org does not guarantee the completeness or accuracy of any information contained in, or provided in conjunction with the http://www.raceentry.com website. Race Entry and its partner 5Kevents.org is not responsible for any omissions or inaccuracies, or for the results obtained from this information.
Race Entry and its partner 5Kevents.org facilitates registration for various events, some of which allow participants under the age of thirteen (13). We require a submission of birth date for all registration entries. For children under the age of thirteen (13), parental or guardian consent is required.
You agree that the statutes and laws of the State of Utah, USA, will apply to all matters relating to this Agreement and Waiver. You irrevocably consent that exclusive jurisdiction for any dispute with Race Entry and its partner 5Kevents.org relating to this Agreement and Waiver resides in the courts of Utah, and you further agree and expressly consent to the exercise of personal jurisdiction in the courts of Utah in conjunction with any such dispute including any claim involving Race Entry and its partner 5Kevents.org.
