5K Event Waiver and Release

By registering for this event, you agree to the following:

Waiver and Release of Liability:

• You, and your parent or guardian if you are under 18, release 5Kevents.org, sponsors, affiliates, volunteers, and organizers from any and all claims arising from your participation in the event.
• You acknowledge the inherent risks of participating and assume full responsibility for your safety.
• You agree to abide by all traffic regulations during the race.

Medical Release:

• You confirm you are physically fit and trained to participate in the event.

Use of Personal Information:

• You consent to the collection and use of your personal information as outlined in the Privacy Policy.
• You grant permission for the use of your name and/or image in event materials.

Payment and Fees:

• You acknowledge the charge will appear as 5Kevents.org or Raceentry and online fees/donations are non-refundable.
• You understand a percentage of charitable donations may be withheld for administrative costs.

Limitations of Liability:

• 5Kevents.org is not liable for any damages arising from participation.
• The information provided on the website is not guaranteed to be complete or accurate.

COVID-19 Release Waiver (if applicable):

• You confirm you and your household members are free of COVID-19 symptoms in the past 14 days.
• You confirm you and your household members haven't been diagnosed with COVID-19 in the past 30 days.
• You confirm you and your household members haven't been exposed to anyone with COVID-19 in the past 30 days.
• You confirm you and your household members haven't traveled to a COVID-19 hotspot in the past 30 days.
• You acknowledge 5Kevents.org is not liable for misinformation or participant health history.
• You agree not to participate if exposed to COVID-19 within 30 days of the event.
• You understand registration is non-refundable but allows transfer to Remote Runner Categories.
• You agree 5Kevents.org will ship race swag to your address if transferred to a Remote Runner Category.
• You release 5Kevents.org from liability for unintentional exposure or harm due to COVID-19.

Additional Terms:

• Minimum age requirement and parental consent are in effect for participants under 13.
• Registration fees are non-refundable.
• The event will be held rain or shine. Fees are non-refundable in case of cancellation.
• Communication: You agree to receive event-related communications via text and email. Your privacy is protected.
• Opting Out: You can opt out of communication by replying "STOP" to text messages or using the unsubscribe option in emails. Be aware that opting out will prevent you from receiving event updates and confirmation messages.

Dispute Resolution:

• This agreement is governed by the laws of Wisconsin, USA.
• Disputes will be settled exclusively in Wisconsin courts.
• In case of a dispute, mediation will be attempted before resorting to arbitration or litigation.

WAIVER: I, the undersigned participant (and my parent or guardian if I am younger than 18 years of age), intending to be legally bound, do hereby forever release and waive any and all rights, claims, and actions for damages that we, our heirs, executors, administrators, and assigns may have, or that may hereafter accrue against any and all persons, organizations, and other entities associated with the event, including, but not limited to Race Entry, 5Kevents.org, sponsors, affiliates, volunteers, and individual organizers, arising out of or in connection with my involvement before, during, or after the event.

I verify that I am physically fit and sufficiently trained to participate in this event and I assume the risks involved in this activity. I further attest that I will be mindful of traffic along the race course, and hold said sponsors and organizers blameless in any harm that may happen.

I consent to the collection and use of my Personal Information as contained in the Privacy Policy. I also give my permission for the free use of my name and/or pictures in telecasts, broadcasts, newspapers, posters, advertising, etc.

I also acknowledge understanding that the charge to my card will show up as Race Entry. I acknowledge that the online processing fees and charitable donations are non-refundable. I also acknowledge that any charitable donations will have 4.97% withheld from the donation to pay credit card and administrative costs.

Race Entry and its partner 5Kevents.org shall not be liable to me for any direct, indirect, special, incidental, consequential or exemplary damages including, but not limited to, loss of profits, goodwill, use, data or other intangible loses. Race Entry and its partner 5Kevents.org does not guarantee the completeness or accuracy of any information contained in, or provided in conjunction with the http://www.raceentry.com website. Race Entry and its partner 5Kevents.org is not responsible for any omissions or inaccuracies, or for the results obtained from this information.

Race Entry and its partner 5Kevents.org facilitates registration for various events, some of which allow participants under the age of thirteen (13). We require a submission of birth date for all registration entries. For children under the age of thirteen (13), parental or guardian consent is required.

I agree that the statutes and laws of the State of Utah, USA, will apply to all matters relating to this Agreement and Waiver. I irrevocably consent that exclusive jurisdiction for any dispute with Race Entry and its partner 5Kevents.org relating to this Agreement and Waiver resides in the courts of Utah, and I further agree and expressly consent to the exercise of personal jurisdiction in the courts of Utah in conjunction with any such dispute including any claim involving Race Entry and its partner 5Kevents.org.
